Article 370 | India

India is going through a lot of political chaos. Article 370 is a term which is very frequent. It gives Jammu & Kashmir a special status. Lets go through this -
It says -
  • The central govt. cannot impose financial emergency in the state. It can be imposed only on the grounds of internal disturbances and imminent danger from a foreign enemy.
  • State Govt has fully command over how to run the state and the center cannot interfere. Except for Defense, Foreign Affairs, Finance and Communications, the Indian Government needs the State Government’s nod to apply all other laws.
  • The governor would have to be appointed by the recommendation of the state government and not by the center.
  • Indian nationals belonging to other states cannot buy land or property in the state of J&K.
  • Woman who marries a person belonging to any other state loses her right to ownership; however this is a contentious matter. Astonishingly, if the same woman marries a man belonging to Pakistan, shall not be debarred from holding onto the citizenship and the property rights.
  • The 1952 Delhi Agreement also specified that the state should have its own flag in addition to the Union flag and they should have the same status.
  • Fundamental rights enshrined in the constitution cannot be made applicable to the state .
And a lot more.
This sounds extremely wrong, but is actually correct. If it is a state of India, why these stuff are still operational? It was destined to be temporary. Its been more than 60 years of independence and yet government is unable to come up with some way out. J&K is now nothing like ‘heaven’ or ‘Switzerland of East’. It is turning itself into the habitat of Mercenaries and terrorists. I have some friends from J&K on FB and they do not care or respect our country. Some strict actions must be taken. This article needs to be amend but recently, Supreme Court of India has concluded that this Article is now permanent.
